1. Who we are
Resi is offered by Lake52 B.V. ("we"), chamber of commerce (KvK) 42088051, Prinses Marijkestraat 52, 1077 XD Amsterdam, Netherlands, privacy@lake52.nl. By creating an account or using the app you agree to these terms.
2. What Resi is
An app for keeping a kilometre record, for self-employed people and other businesses. Resi records trips, automatically or by hand, helps you classify them as business, private or commute, and produces reports for your records.
3. Account and use
- You need an account (e-mail, Google or Apple). You are responsible for what happens under your account.
- You use Resi as a business, for your own records, not for unlawful purposes, and you do not disrupt or reverse engineer the service.
- You are at least 16 years old.
4. Trial and subscription
- Trial: 30 days of full, free access, without a payment method.
- Subscription: after that, one all-in subscription. You see the price and the term in the app and in the App Store before you buy.
- Renewal and cancellation: your subscription runs through your App Store account and renews automatically unless you cancel in your App Store settings at least 24 hours before the end of the period. You keep access until the end of the period you paid for.
- Refunds: according to the App Store refund policy.
- Price changes are announced in advance and take effect at your next renewal.
5. Your records, your responsibility
- Resi is a tool, not an accountancy firm, and gives no tax, accounting or legal advice. Rates and calculation rules in the app are indicative.
- The records are yours and are your responsibility: their accuracy, their completeness, and what you file with the tax authority or anyone else.
- Check your trips and reports before you use them, and at least once every filing period. You correct missing, duplicate or incorrect trips yourself in the app.
- Automatic detection is a best-efforts obligation. Whether and how a trip is recognised depends on your device, the operating system, your permissions and settings, and on circumstances outside our control such as GPS reception, power management or a forced quit of the app. We do not guarantee that every trip is detected, or that a detected trip is complete and correct.
- We are not liable for trips that were not recorded, or recorded incompletely or incorrectly, or for the consequences, such as a missed deduction, an additional assessment, a penalty, interest or the cost of putting it right. Section 11 applies in full.
- We make no promise about tax acceptance of a report or an export. If in doubt, ask your bookkeeper or adviser.
6. Backup and keeping your data
- Keeping copies is your responsibility. Resi is not an archiving or backup service. Export your trips and reports regularly and keep those copies yourself.
- This applies to your trip data just as much. Recorded, confirmed and still-open trips, addresses, customers and projects are part of your records. Keep your own copies of those too. That responsibility runs for as long as the agreement lasts, and afterwards.
- We take reasonable measures for continuity, but do not guarantee that data is kept or can be restored, whatever the cause.
- Deleting is permanent. The tax retention obligation of seven years is yours. Export before you cancel or delete.
7. Your data
- How we handle personal data is set out in our privacy statement. Your trips, addresses and locations stay in the EU and go to no AI model. Resi works with rules that run on your phone.
- Your data is and remains yours. You can view it, export it (JSON, PDF, XLSX) and delete it together with your account, immediately and permanently, in the app.
- We never sell data that can be traced back to you and never use it for anything other than Resi itself. There is no setting and no agreement that makes it possible after all.
- Anonymised data is used only to resolve faults and incidents and to improve Resi. That data is not sold either.
8. Contributing more: you switch it on
- If you want to contribute more, meaning training our detection with your depersonalised trips, research recordings of trips, or anonymous product analytics, you switch it on yourself in Settings > Privacy.
- These options are off by default. Taking part is voluntary, declining has no consequences for your subscription, and you can withdraw at any time with effect for the future. What has already been irreversibly anonymised can no longer be linked to you and cannot be retrieved.
- Research recordings stay on your phone until you share one yourself.
9. Availability and changes
We do our best to keep Resi available, but do not guarantee uninterrupted or fault-free operation. We may add, change or remove features. If a change materially limits the core of the app for you, we will tell you in advance and you can cancel before your next renewal.
10. Intellectual property
The app, the Resi brand and the software and design that go with them belong to Lake52 B.V. or its licensors. You receive a personal, non-transferable, non-exclusive licence to use the app for your own records.
11. Liability
- We are not liable for indirect damage, such as a missed deduction, an additional assessment, a penalty or consequential loss arising from incorrect, incomplete or missing trips or reports, nor for loss of data (sections 5 and 6).
- Our total liability per event is limited to what you paid in subscription fees in the 12 months before it.
- A claim lapses if you have not informed us in writing within twelve months of discovering it.
- These limitations do not apply in the case of intent or wilful recklessness, or where the law does not allow a limitation.
12. Ending
You can stop at any time: cancel the subscription through the App Store, and delete your account in the app if you want to. We may suspend or end your access in the case of misuse, fraud or a material breach of these terms; where reasonable we warn you first.
A suspension or ending can make your trips and reports temporarily or permanently unreachable. Your responsibility under section 6 to keep your own copies applies then as well — especially then, because at that point you can no longer export.
13. App Store
The app is delivered through the Apple App Store. Apple is not a party to this agreement. To the extent that Apple's terms for licensed applications (Licensed Application End User License Agreement) apply mandatorily, they apply in addition.
14. Changes to these terms
We inform you in advance, through the app or by e-mail, of material changes. If you keep using the app after that, the new terms apply. The current version is at https://resi.my/en/terms.
15. Governing law
Dutch law applies. Disputes go to the competent court in Amsterdam, unless mandatory law provides otherwise.
